The President warned on Tuesday that he would pardon Joseph Michael Arapaio, who was convicted of criminal contempt of court by a federal judge. The conviction stemmed from civil suits brought by the American Civil Liberty Union for his blatantly prejudicial oversees in the racial profiling of Latinos in violation of federal law, and flagrantly ignoring an earlier injunction by a federal judge to cease so-called saturation patrols. By Friday the presidential pardon was granted for the former Sheriff of Maricopa, a county shared by three cities, Phoenix, Mesa, and Glendale in Arizona, much to the chagrin of the minority population, of which nearly 30% are Latino.

In an apparent abandonment of rationality, the deliberate targeting of Latinos by the former sheriff was made plausible, electorally, by a tyranny of the majority. A majority that racially comprises of 70% white. Surely, not all white people agreed with Sheriff Arapaio’s tactics which included but was not limited to…

…however, the use of clever circular reasoning will hinder or stall any effort to reject the pardon because the check and balance of powers serve in both capacities. A check on the president by the courts can be controvertible to a check on the courts by the president who has been elected by the people. By the people, and by this contexture in Trump’s political capacity, is essentially by the tyranny of the masses. The Tyranny of the Masses is defined below.

Tyranny of the majority (or tyranny of the masses) refers to an inherent weakness of direct democracy and majority rule in which the majority of an electorate can place its own interests above, and at the expense of, those in the minority. This results in oppression of minority groups comparable to that of a tyrant or despot.[1]

Potentially, through tyranny of the majority, a disliked or unfavored ethnic, religious, political, social, or racial group may be deliberately targeted for oppression by the majority element acting through the democratic process.[2]

There is more to former Sheriff of Maricopa County who directly involved himself into the birther movement and controversy over Barack Obama’s legitimacy to be president. As reported by NYMag

Maricopa County sheriff Joe Arpaio would assign a five-man “Cold Case Posse” to probe the authenticity of Obama’s birth certificate, he told Jerome Corsi, the former World Net Daily columnist and Ur-birther. “When I get allegations brought to me by the citizens of Maricopa County, I look into the allegations, just like I am doing here,”

But at the time of these incidences the gravitas of the matter never carried much weight for national reporting, nor congressional rebuke. One contributing factor remains evident, the tyranny of the masses provides the impetus, thus endorsing and championing such incivility and schadenfreude with remarkable subtleties.

In the fall of 2007, Arpaio quipped on CNN’s Lou Dobbs Tonight that he thought it was “an honor” to be compared by his critics to the Ku Klux Klan. The Justice Department found his operations involved “a widespread pattern or practice of law enforcement and jail activities that discriminate against Latinos.” In 2010, Arpaio headlined a rally on the U.S.-Mexico border with some of the most notorious white supremacists. The list is endless.

Running Amok of our Judiciary

Many legal scholars have opined that the president’s pardon undermines the legal system in an unprecedented fashion that leads to questions of presidential overreach. Noah Feldman, a Harvard law professor, argued that such a pardon “would express presidential contempt for the Constitution.” Add a degree of vindictiveness and we clearly have an incompetent demagogue that has slipped through the cracks of democratic principles. Alexander Hamilton had warned and with all intents and purposes proposed an electoral process that would weed out the unscrupulously, self-righteous and the malignantly ignorant.

It was desirable that the sense of the people should operate in the choice of the person to whom so important a trust was to be confided[…]

It was equally desirable, that the immediate election should be made by men most capable of analyzing the qualities adapted to the station, and acting under circumstances favorable to deliberation, and to a judicious combination of all the reasons and inducements which were proper to govern their choice[…]

Nothing was more to be desired than that every practicable obstacle should be opposed to cabal, intrigue, and corruption. These most deadly adversaries of republican government might naturally have been expected to make their approaches from more than one querter, but chiefly from the desire in foreign powers to gain an improper ascendant in our councils.[…]

The process of election affords a moral certainty, that the office of President will never fall to the lot of any man who is not in an eminent degree endowed with the requisite qualifications. Talents for low intrigue, and the little arts of popularity, may alone suffice to elevate a man to the first honors in a single State; but it will require other talents, and a different kind of merit, to establish him in the esteem and confidence of the whole Union, or of so considerable a portion of it as would be necessary to make him a successful candidate for the distinguished office of President of the United States.[…]

Democratic subterfuge accomplished

In 2016, the tyranny of the masses prevailed and awarded the highest office in the land to a divisive majoritarian with extraordinary powers to represent and lead a plural nation in an attempt to make America great again.

There is more that underlie these #MAGA enthymematic arguments which I will obligingly fill in here. Donald Trump does not have to explicitly state all the viscerally bigoted remarks that are inherent to the white nationalist sphere of whom benefit from a status quo of privilege and discrimination. Rest assured that Trump can rely on these oftentimes silent, resentful, and hidden in plain sight supporters that he has boastfully emboldened, garnered and inspired to imbue such messages of ironic nativism that check, inform, and regulate second class citizenry of whom can only be relegated to marginalization in America.

For reasons other than the commercialization of dissension (political media complex) and divisiveness (tribalism) within our society, the national media has seemingly supported demagoguery instead of true leadership by downplaying incidences like these. This is made to to make the discordant issue of race a one-sided card game that give the impression that minorities are ungrateful and bitter inhabitants who seek to destroy the so envied white nativist version of America.

This remarkable display of sincere fiction is tantamount to the continuation of racial survivalism and is quite apparent that this is more than just aimed at anti-immigration with the incessant barrage of spoken and visual enthymematic arguments being made to sustain inequality, while asserting national security.

Whenever I read or hear journalists, stat-junkies, or pundits declare that it won’t be long until whites become the minority in America, I suspect that presumably there is some sense that widespread jubilee will commence among current minority groups when those demographics actually prevail. That suddenly all things unequal will become more equal. That what is perceptibly unfair will become fair. That discrimination will evanesce. That bias would recede from views.

That is all laughable though.

While the more sanguine among us may see a more balanced and fairer American society, others including myself will remain quite cynical of any amelioration for this future society. This alleged newfound minority will continue to wield power and wealth collectively and that chasm will take more than just a few decades for parity to fill, let alone break the prevailing phenomena.

So all this talk of comeuppance mainly from the moral precept of white antagonists is just rabble-rousing divisively sown and inadvertently —perhaps propagated by census data. This notion just stokes unwarranted fears and angst and emboldens the worst of intents. Regrettably, the tyranny of the masses will always reject diversity, equality and liberty for all.
